1. Acceptance of Terms

By accessing, registering, or using MS PROS ("the Service"), you agree to be bound by these Terms of Use. If you disagree with any part of these terms, you may not access the Service. MS PROS is operated by Matias Strappolini ("we", "us", or "our") with business domicile in the State of Florida, United States.

2. Description of Service

MS PROS is a platform that provides prospecting opportunities to contractors and home improvement professionals ("Subscribers"). The Service consists of delivering monthly prospect lists (homeowners) based on public domain information, along with optional management tools (quotations, CRM).

MS PROS is NOT a consent-based lead generation service. The prospects included in our lists have NOT requested a quote, have NOT consented to being contacted, and have NOT expressed interest in receiving services. The information provided is based exclusively on public record data.

3. Nature of Data Provided

The prospect data we deliver comes from public information sources, including but not limited to: county property records, public building permits, and other publicly accessible government databases. This data may include property owner name, property address, and phone numbers associated with the public record.

MS PROS does NOT guarantee the accuracy, completeness, or currency of this data. Data is provided "as-is" without warranty of any kind.

4. Contractor Responsibility — Legal Compliance

THIS SECTION IS OF SPECIAL IMPORTANCE. READ IT CAREFULLY.

By subscribing to MS PROS, you acknowledge and agree that:

  • You are solely responsible for contacting prospects in compliance with all applicable federal, state, and local laws, including but not limited to:
    • The Telephone Consumer Protection Act (TCPA, 47 U.S.C. § 227)
    • The Florida Telephone Solicitation Act (FTSA, Fla. Stat. § 501.059)
    • The National Do Not Call Registry
    • The Florida State Do Not Call Registry
    • Any other applicable federal, state, or local regulation
  • MS PROS does not provide prior express consent from prospects to be contacted by phone, text message, or any other means.
  • It is your sole responsibility to check the National Do Not Call Registry and the Florida State Registry before making any telephone contact.
  • It is your sole responsibility to obtain the necessary consent before sending text messages or making automated calls (robocalls).
  • MS PROS shall not be liable for any fines, lawsuits, or legal actions resulting from your use of the provided data to contact prospects in violation of any applicable law.

5. Indemnification

You agree to indemnify, defend, and hold harmless MS PROS, its owners, directors, employees, and agents from and against any claims, demands, losses, damages, costs, or expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of the prospect data provided by the Service; (b) your failure to comply with any applicable law when contacting prospects; (c) your violation of these Terms of Use.

6. Internal Do Not Contact (DNC) System

MS PROS maintains an internal "Do Not Contact" list. If a homeowner requests not to be contacted — whether directly to you or through any channel — you must immediately report it through the platform using the "Report: asked not to be contacted" button in your leads panel.

Once a prospect is marked as "Do Not Contact," they will be automatically excluded from all future lead deliveries to all subscribers. Failure to report do-not-contact requests may result in termination of your account without refund.

7. Plans and Payments

MS PROS offers the following monthly subscription packages:

  • Starter ($150/month): 30 monthly prospects in your area.
  • Pro ($180/month): 30 monthly prospects + access to the AI-powered quotation app.

Payments are processed securely through Stripe. Subscriptions renew automatically until canceled. You may cancel at any time from your account settings; cancellation will be effective at the end of the current billing period.

8. Refund Policy

Due to the nature of the service (data delivery), NO refunds are offered once the month's leads have been delivered. If leads have not yet been loaded into your account, you may request a refund within the first 48 hours after the charge by contacting mspros2026@gmail.com.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MS PROS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (a) YOUR USE OF OR INABILITY TO USE THE SERVICE; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (c) THE ACCURACY OR QUALITY OF THE PROSPECT DATA PROVIDED.

Our total maximum liability is limited to the amount paid by you in the last 30 days.

10. Termination

We reserve the right to suspend or terminate your account immediately, without prior notice, if: (a) you violate these Terms of Use; (b) you fail to report do-not-contact requests; (c) you use the provided data unlawfully; (d) you engage in activities that expose MS PROS to legal liability.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without giving effect to any principles of conflicts of law. Any disputes shall be resolved in the courts of Lee County, Florida.

12. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon posting on this page. Your continued use of the Service after the posting of changes constitutes your acceptance of the new Terms.
